Understanding Fraud Charges
Fraud charges generally involve allegations that someone used deceit, falsehood, or another dishonest means to take money, property, or services from another person or the public.
Under section 380 of the Criminal Code, the potential penalty depends in part on the amount involved. Fraud over $5,000 can carry a maximum sentence of 14 years in prison. Fraud involving $5,000 or less can carry a maximum sentence of two years.
Building a Strong Defence
A fraud charge requires the Crown to prove specific elements beyond a reasonable doubt, including that a dishonest act took place and that it resulted in deprivation, or a risk of deprivation, to another person or the public.
Depending on the circumstances, a defence may focus on challenging whether the conduct meets the legal definition of fraud, questioning the reliability of the evidence, or negotiating an appropriate resolution with the Crown.
